Green Man Gaming Says Resale Decision Will Reshape Gaming Industry

The European Court of Justice decision that opens the rights of software buyers to then resell their product needs to be first tested by one or more gamers before publishers and digital platforms will have to create the infrastructure needed to support this personal right.

Paul Sulyok, the chief executive officer working at Green Man Gaming, has told Eurogamer that, “Some first acquirer somewhere is going to push this through, because it’s the kind of thing the community does, and it’s their right to.”

“There will be a first case against one of the platform holders. The result of that is a foregone conclusion. So they will have to facilitate that. This will shake up the digital distribution market,” he continued.

The main impact will be on the Steam service from Valve and Origin from Electronic Arts, which will have to either pull out of the European market or create some sort of system to allow re-sale.

Of course, it’s likely that both companies will try and extend the legal process before any ruling on the issue so that they have time to complete the switch.

Sulyok added, “It’s only one step away from being in a situation where a first acquirer says, I would like to have the rights to do this and I have the right to do this, therefore your system should facilitate it. It does link together.”

The executive also believes that digital distribution services will no longer offer the price cuts that they are currently delivering during promotions because that would flood the market with very cheap titles.

Green Man Gaming was launched with the promise that it would always offer a secondary market allowing players to trade in their digital games.

No other video game publisher or digital distribution service has so far commented on the decision coming from the European Court of Justice.
