Grooveshark Wins a Couple of Big Victories Against Universal, Long War Still Ahead


Grooveshark was able to win quite a victory in its battle against the major record labels.

Universal Music, in a lawsuit that was later joined by the other labels with the exception of EMI, which is suing the music site separately on a different matter, argued that Grooveshark not only condoned copyright infringement, it encouraged it.

The label believes that even the employees, going all the way up to the CEO, were involved. Besides those charges, Universal also tried to make a rather curious argument, that pre-1972 music was not covered by the DMCA, meaning that sites were not protected if users uploaded the songs.

The details are technical, but the good news is that the court threw out the argument and said that any copyrighted work is protected by the DMCA.

At the same time, the court also rejected Universal's attempt to dismiss some of Grooveshark's counterclaims. A couple of victories for the music site, but the war is far from over.
